Simanta Dutta, 31, the Vice President of an IT firm based in Bengaluru has finally won a case filed with the consumer court after a 3 year battle. In October 2015, Dutta wanted to transport his 2013 Hyundai Elantra from his hometown in Assam, Margherita to Bangalore.
He contacted Agarwal Packers and Movers in India, who assured him of safe transportation of the vehicle to Bengaluru and Dutta paid Rs.43,670 as transport charges. The packers took possession of the vehicle on October 9, 2015 and assured delivery by October 26.
On the due date, with no delivery completed, Dutta approached the Packers and their representatives at the Lalbagh Office. After much coaxing and tracking the Hyundai Elantra was finally delivered on November 6, 2015 at the authorized service station in Domlur.
Though delivered, the Hyundai Elantra was soaked in water and had suffered extensive damage during transport and thoroughly unfit for use. This left Dutta with no other recourse than to approach the Consumer Court. A three year battle ensued with the final order that the packers and movers have to pay the owner a full refund towards damage in addition to compensation of Rs.80,000 for the trauma caused to the customer.
